Can you recall a single test where SportAuto mentioned something similar about the test car? They clearly would not mention their doubts if they were not certain that the test car came in non-standard configuration. They just put it in mild worlds not to annoy a good advertising customer (BMW) too much, I guess.

As far as I know there is a power tolerance of 5% in Germany. If your car has more power you can get at least trouble with your insurance (Kasko) in case of a accident.
Breaks: „Die Bremse ist trotz kreischender, sicher nicht serienmäßiger Beläge kein Bringer“. As MKSGR said I never read something similar in Sport Auto.
Sorry I think a test in a car magazine if the car is equiped with special (Tuning) parts is useless.
And I have no problems with BMW in general, I often use a X6 Diesel, good car.
