    IMHO China can never truly be respected by developed nations until it learns to respect intellectual property rights. Companies spend millions on R&D which then gets 'protected' by patents. Chinese companies then violate these intellectual property rights by producing cheap knock-offs while the one-party Chinese State does absolutely nothing to stop these blatant infringements. It's just shocking.

    You're absolutely right. But before I start screaming "foul" I want to check if they are really infringing.

    Is the look of a car protected? If so then not under patent laws.

    And my guess is, they just copied the look, everything else is the same crap they already have.

    @Eunice: patents protect technology but can also protect design where that design is integral to the protected idea. Certain 'signature' stylistic cues can also be protected as trademarks while logos can always be protected as registered trademarks.

    In English law, there is no question that a car that looks identical to that of another manufacturer constitutes the tort (civil wrong) of 'passing off' i.e. passing off someone else's design as your own.

    Can be translated as design patent or registered design - however it is not as valuable as a patent since it is, in judicial terms, only as effective as a utility model. The equivalent form of legal protection to a patent would be the copyright which is instantly applied in arts and writing but almost non-existent in design.

    Wasn't there a legal case with the previous X5 that was copied by the chinese, in German courts?

    I think the case was won by BMW but it couldn't be enforced everywhere. I am not exactly sure.

    Their crash safety for example seems more than questionable... they seem to be still in the Flinstone era The chinese brand was Brilliance is re-attempting to penetrate Europe and their BS4 model has just recieved... wait for it... 0 stars on the EURONCAP crash test just like their previous BS6 two years ago...

     I´ve seen the article in AMS ... but I think it is just a fake made by someone to create some debate on internet. If you look close to the picture you will see that it looks more as a Potoshop filter to make it look like a photo of a picture taken with a phone from a magazine. Also the central air intake with the BYD logo on it, to me, looks like a paste and copy not being an actual object on an existing car. Also it is too shiny compared to the other chromed elements on the car. And the contrast is way too sharp compared to the rest of the picture. So for now on.. I will take it as a fake... but being the chinese in the middle... you never know...
