    Important questions to ask the Porsche Dealer before order..

    I was hoping that those who have had the traumatic experience of signing an order for a new 997 would be prepared to help create a list of questions that would test the dealers response so that you knew that your order would be dealt with as you expected. I was thinking something along the lines of...

    1) Whether the dealer has had their allocation which could mean that additional orders could potentially be delayed

    2) Deposit process. When they are paid, how much is paid. At what stage can you get your deposit back.

    3) Tips to speed up delivery. What Extras not to order that could delay delivery.

    That sort of thing...

    This would be very helpful and could be a good sourse of information to be included in a FAQ perhaps.

    I have dealt with these questions in the form of a purchase contract. In it will be names of both purchaser and seller. Complete vehicle description including all option codes. Total price of vehicle. If you have a trade-in a complete description of trade-in along with VIN. Agreed value of trade-in and total balance due. Amount of deposit and schedule for payment. You can include a delivery by date that will either give you the right to sue for non-performance or complete refund of all deposit(s). Be sure to include a clause stipulating what will happen to vehicle if you die before being able to take delivery. I also include clauses dealing with "force majeur" for both purchaser and seller. Included can be terms that will deal with your particular situation. Above all be business like and fair to all parties involved. Over the years I have found it is far cheaper to get your attorney involved before purchase than after.

    Wow! In the UK I have never heard of a Lawyer/solicitor being involved to buy a car. It makes sense though as we need one to buy a house which in the past was less than Pounds70k.

    Love the non performance bit.

    Wow, must be a lawyer yourself?

    How do you say "force majeur" in US juridic terms ?

    It used to be "Act of God", but then He sued for libel 'cos He was tired of being blamed for everything!

    It is really interesting how different the purchase experience can be in different dealers and different countries.
    Without using an attorney, I went to the dealer in April 2005 and asked : when will a 997S be deliver if I order it today then we went trough the options, told me that a $1000.00 will be sufficient and it is fully refundable even if I change my mind after the car arrived at the dealer. I asked him how long do I have to make changes to my order, I added and chaged different options trough that time and a week before I coudn't make anymore changes the dealer informed me.
    Then he kept me informed every two weeks about progress and production date and in August I got my car.
    It really seems not a very businesslike practice how some of these dealers do business.

    I'm having a roughly similar experience. I put $1,000 down (more required if you order a special custom paint - usually $10,000) and got progress reports from my salesman. My 997S has been completed and is being shipped this week, with anticipated arrival at the port of Baltimore by Feb. 7 and delivery to me about one week after that.

    Though I hold a law degree, I never considered drafting a "Purchase Agreement" with "force majeur" provisions, or any agreement other than that provided by the dealer, for that matter. I am relying on the fact that the dealer is reputable and I will be treated fairly in unforeseen events.
    I am enjoying the rapport I am having when I stop by the dealer after the order through pre-delivery time. Like being tossed the keys to dive a new Cayman.No copy of my license, no insurance card...that sort of thing. Not sure I would get the same treatment if I had showed up with my own six page contract. Buying a car is my pleasure, and I like to leave the business end of it to the reputation of the dealer. Just my 2cents. no offense to anyone who needs to "lawyer up" to feel comfortable in the process. Naturally a buyer should be savy as what questions need to be asked re: allocation and delivery dates. However having ordered factory built P Cars befpore, no assurances regarding build dates or delivery is set in stone.

    For those who have a working relationship with a local dealer I congratulate you. Don't ever loose that trust. It is the most valuable asset you have. But if one travels a great deal, is out of the country for months, or in a different part of the country for months you may wish to consider such a document. As I said it depends on ones individual circumstances. And the point to remember is always be fair to all parties involved.
