    Tesla is found guilty of throttling charging speed, asked to pay $16,000 to thousands of owners

    In court in Norway, Tesla was found guilty of throttling charging speed and battery capacity through a software update.

    Unless it appeals, Tesla is going to have to pay $16,000 to each of the thousands of owners affected in the country. The fine could be even more significant as other similar legal efforts are on the way in other countries.

    Back in 2019, Electrek reported on several reports from Tesla owners about seeing significant drops in range from 12 to 30 miles following a software update.

    Only Model S and Model X vehicles with 85 kWh battery packs, which were discontinued in 2016, seem to be affected at that point.

    For most owners, the range drop happened after updating to Tesla’s 2019.16.1 and .2 software updates.

     

    Rasmussen has been plotting the battery capacity degradation of his Model S over the last 100,000 miles or so, and the drop is quite obvious:

    There could be over 10,000 Tesla owners affected by the update in Norway alone, which could make the fine quite pricey for the automaker, but more importantly, it could also set the tone for several other similar lawsuits, including one in the US.

    So I suggest not buying a six year old Tesla.  Good thing the numbers back then are tiny. Tech is improving. 
    It does make for a good sounding story except nobody was hurt, no cars stopped running, nothing caught on fire. One might notice how amazing it is that Tesla can monitor its fleet so well and look after the condition of the battery. These are all out of warranty now so I would bet they would like some out of warranty $. 
    Personally I’m curious if owners had been given a choice to get the update and thereby extend the battery life at the expense of some range and charging speed if they would have volunteered. I would have not passed on this type of update. 
    It is also worth noting that unlike any other automakers Tesla has also pushed over the air updates which increase range, charging speed and power. Not to mention safety. Long after the sale was made and customers paid their money. No mention of this or customers complaining.  Given that, the problem is mostly with the negative press. Tesla owners are still the happiest bunch out there. Plus $16k for some.  Ever buy back a fleet of diesel cars?

    The technology is evolving so fast that Tesla is moving to a vision-based system with more limited functionality than its previous ADAS with radar based systems.  Once again, Tesla ignites consumer confusion.

    Ya think?  Too funny. ‘A comment from the automaker might clear this up’ but in the meantime let’s just pretend we have news and print whatever.  Priceless. 
    Now for some real facts - during the transition to using only vision auto steer will be limited to 75 mph initially. Not certain how long that will be.  Summon will also be impacted during the initial rollout. Both those suck a lot but odds of the new system eventually being much better are good.  As for that graphic showing all those features removed - you really believe that?  Read the article.

    Tesla is finally releasing a driver monitoring system using its cabin-facing camera to ensure drivers are paying attention when using its Autopilot and Full Self-Driving package features.

    It’s a feature that the automaker inexplicably has taken its sweet time to release.

     

    Tesla’s cabin-facing camera has been in the vehicles for years now, but the automaker has barely used it.

    Automakers generally implement cabin-facing cameras for driver monitoring while using driver-assist features, like GM with Supercruise.

    However, CEO Elon Musk has previously dismissed the use of a camera-based driver monitoring system and said that Tesla would use its cabin-facing camera to prevent people from vandalizing cars when they are being driven automatically on Tesla’s upcoming self-driving robotaxi network.

    Last year, Tesla activated the camera for the first time in a software update asking people to allow the automaker to take videos and pictures to “develop safety features and enhancements in the future” on a voluntary basis.

    Lately, the camera is being discussed more often after it was revealed that Tesla removed some owners from its FSD beta program after determining that they weren’t paying enough attention when using the system.

    It pushed some to asked the question: If Tesla can determine that drivers aren’t paying attention, shouldn’t it warn drivers in the moment?

    We knew that Tesla had the capacity since a hacker demonstrated exactly what the automaker’s cabin-facing is looking for — pictured above.

    Now, Tesla is finally deploying its driver monitoring system in a new software update: 2021.4.15.11.

    The automaker wrote in the new release notes:

    “The cabin camera above your rearview mirror can now detect and alert driver inattentiveness while Autopilot is engaged. Camera data does not leave the car itself, which means the system cannot save or transmit information unless data sharing is enabled.”

    Tesla does note that owners can change the data sharing setting by going to “Controls > Safety and Security.”

    The new update coincides with Tesla’s release of its new Tesla Vision system that solely relies on computer vision using cameras and no radar.

    Electrek’s Take

    It is important to note that Tesla is not removing the need to keep your hands on the steering wheel and be ready to take control at all times.

    Other automakers who implemented driver motoring systems have removed the requirement to keep your hands on the steering wheel as long as they can detect that you are paying attention to the road.

    It looks like Tesla is not quite there yet, but it will be interesting to see where the company takes that features.

    They could also use it to gradually reduce the Autopilot nag, but I doubt that they will remove the hands on steering wheel requirement as Tesla seems determined to jump from level 2 to level 5.

    Let’s see how that plays out.

    Well this should make everyone who hated autopilot just love Tesla now.  
    It is funny how they imply that Tesla is not as advanced as the other systems because they had not implemented this. As though the other systems are more capable, which is hilarious.  Once there are actual competitors on the roads the accident stats will be very interesting. Even current Tesla’s stats are outstanding and will be hard to match. 
    It will be fun to watch the new model S delivery day later this next week.

    Tesla’s “Standard” safety features for Model 3 and Model Y get an NHTSA update

    The National Highway Traffic Safety Administration (NHTSA) has updated its website’s pages for the 2021 Model 3 and Model Y amid the EV maker’s shift to a pure vision approach. As could be seen on the safety agency’s site, several safety features are no longer listed as “Standard” on the two vehicles, at least for cars produced after April 27, 2021. 

    A look at the NHTSA safety ratings for the Tesla Model 3 and Model Y now shows that the two electric cars do not have forward collision warning, lane departure warning, crash imminent braking, and dynamic brake support listed as “Standard.” As per reports from Reuters, the safety agency’s update was made following Tesla’s removal of radar for its two mass-market EVs. 

    Tesla has reportedly briefed the NHTSA about the change in its Model 3 and Model Y production. 

    According to the agency, it “only includes check marks for the model production range for vehicles tested.” With this in mind, it appears that the NHTSA has not yet conducted specific safety tests on Tesla’s pure vision Model 3 and Model Y. Teslarati has reached out to the NHTSA to gain more insight about when and if the safety features will be listed again as “Standard” in the future, but is yet to receive a response. 

    It should be noted that both the Tesla Model 3 and Model Y have received 5-Star Safety Ratings from the NHTSA’s crash tests, the highest that the agency could give. These ratings remain unaffected despite the removal of forward collision warning, lane departure warning, crash imminent braking, and dynamic brake support, as part of the EVs’ “Standard” features. 

    Tesla’s shift to pure vision for the Model 3 and Model Y is proving controversial considering that radar has played a notable part in keeping the company’s vehicles safe over the years, especially at times when visibility is low. Tesla CEO Elon Musk, however, has noted on Twitter that a radar-less, pure vision approach would pave the way for better Autopilot performance. Musk noted that this would be demonstrated by a pure vision version of the FSD Beta, which is expected to be released soon.

    Tesla has enabled the in-car camera in its Model 3 and Model Y vehicles to monitor drivers when its Autopilot advanced driver assistance system is being used.

    In a software update, Tesla indicated the “cabin camera above the rearview mirror can now detect and alert driver inattentiveness while Autopilot is engaged.” Notably, Tesla has a closed loop system for the data, meaning imagery captured by the camera does not leave the car. The system cannot save or transit information unless data sharing is enabled, according to Tesla. The firmware update was cited by a number of Tesla owners, industry watchers and bloggers who are active on Twitter.

    Tesla has faced criticism for not activating a driver monitoring system within the vehicle even as evidence mounted that owners were misusing the system. Owners have posted dozens of videos on YouTube and TikTok abusing the Autopilot system — some of whom have filmed themselves sitting in the backseat as the vehicle drives along the highway. Several fatal crashes involving Tesla vehicles that had Autopilot engaged has put more pressure on the company to act.

    Until now, Tesla has not used the camera installed in its vehicles and instead relied on sensors in the steering wheel that measured torque — a method that is supposed to require the driver to keep their hands on the wheel. Drivers have documented and shared on social media how to trick the sensors into thinking a human is holding the wheel.

    “Consumer Reports has been calling for camera-based driver monitoring systems for automation systems like Tesla’s Autopilot for years,” Jake Fisher, senior director of auto testing at CR told TechCrunch. “Tesla’s current system of sensing torque on the wheel cannot tell if the driver is looking at the road. If the new system proves effective, it could help prevent distraction and be a major improvement for safety — potentially saving lives. We hope that other cars are updated soon and are looking forward to evaluating them.”

    Tesla didn’t share details about the driver monitoring system — for instance, is it tracking eye gaze or head position — or whether it will be used to allow hands-free driving. GM’s Super Cruise and Ford’s Blue Cruise advanced driver assistance systems allow for hands-free driving on certain divided highways. Their systems use a combination of map data, high-precision GPS, cameras and radar sensors, as well as a driver attention system that monitors the person behind the wheel, to ensure drivers are paying attention.

    Tesla vehicles come standard with a driver assistance system branded as Autopilot. For an additional $10,000, owners can buy “full self-driving,” or FSD — a feature that CEO Elon Musk promises will one day deliver full autonomous driving capabilities. FSD, which has steadily increased in price and capability, has been available as an option for years.

    However, Tesla vehicles are not self-driving. FSD includes the parking feature Summon as well as Navigate on Autopilot, an active guidance system that navigates a car from a highway on-ramp to off-ramp, including interchanges and making lane changes. Once drivers enter a destination into the navigation system, they can enable “Navigate on Autopilot” for that trip.

    The move comes just a week after Tesla tweeted that its Model Y and Model 3 vehicles bound for North American customers are being built without radar, fulfilling a desire by Musk to only use cameras combined with machine learning to support Autopilot and other active safety features.

    Automakers typically use a combination of radar and cameras — and even lidar — to provide the sensing required to deliver advanced driver assistance system features like adaptive cruise control, which matches the speed of a car to surrounding traffic, as well as lane keeping and automatic lane changes. Musk has touted the potential of its branded “Tesla Vision” system, which only uses cameras and so-called neural net processing to detect and understand what is happening in the environment surrounding the vehicle and then respond appropriately.

    The decision to pull radar out of the vehicles has caused some blowback for the company. Consumer Reports no longer lists the Model 3 as a Top Pick and the Insurance Institute for Highway Safety said it plans to remove the Model 3’s Top Safety Pick+ designation. The National Highway Traffic and Safety Administration has said that Model 3 and Model Y vehicles built on or after April 27, 2021 will no longer receive the agency’s check mark for automatic emergency braking, forward collision warning, lane departure warning and dynamic brake support.

    Great cut and paste. To be clear the forward collision and lane departure warning is simply not turned on by default when you take delivery of the car like it used to be. Those features are still there - of course. You can at any time still go into these settings and turn them on and they will stay on.  They either misunderstood what tesla is doing or they are being obtuse. 

    Do you really think Tesla would remove these features and make their cars less safe?  And of all things remove lane departure and front collision warning?  Seriously?    It does make for another sensational story of doom and gloom around Tesla.  Anyone see the parallels between Trump and Tesla?  Both under attack by the establishment.  And of course it is in print by no less than a federal agency.  
    Stay tuned. I’ll try to find another version of this in print which will shed a bit more light on this.

    Either Tesla is having difficulties ramping up production of the new 4680 cell format, or the performance gains weren’t realized, or customer demand for the Plaid+ is too low to justify the additional engineering and production costs.  Once again Musk is the master of the bait and switch.

    This is what happens when someone doesn’t delegate successfully.   Another senior executive resignation was announced today as the head of energy operations is stepping down.  Retention of key personnel is a consistent issue at Tesla.  Finally, the 4680 cell format was announced almost nine months ago with great fanfare.  Musk, with one Tweet, renders that battery date announcement moot.

    I am waiting for that 'cold air jet' to show up to help a Tesla do sub 2 second 0-60. 

    Physics tells us that it takes a good chunk of time for a jet engine just to spool up and push enough air to get something moving. 

    Unless of course Elon meant strapping some compressed air bottle to the side of there car and knock the tops off and use that instant blast of air as propulsion power. 🤔

    Between resting their batteries and refilling the compress air bottles, it might take a few hours in between 0-60 runs.

    Is it just me or are you all disappointed by the plaid?

    Not using the new 4680 battery pack or structural battery pack. Numbers are also optimistic. Just seems like a bigger model 3 since it is not using the latest announced tech.  
    The regular S, which seems like the bargain, not available until late in the year.  
    Add an extra $10k to the price of the plaid like last week and I personally think they missed the mark. 
    still - the competition is further behind so does Musk care?  He certainly has some reserve tricks remaining.

    I'm more disappointed that there will be no Plaid+, because it would have allowed for fast long distance driving over here. My guess would be, that the new battery tech doesn't work as expected, needs more work or will never work at all. Meanwhile sales for Modell X and S are practically zero in Germany.

    Anything over 300 miles of range is no issue for me so the 400 for the normal S would be fine for me.  Even in my 3 I don’t see any range degradation at up to 85 mph. Plenty for the US. Cold is a bigger problem than speed, at least from what I have seen.  Maybe they could make an extra long range with less performance for Europe. 165 mph should be fast enough. More than current Mercedes limits.
