DJM48:Sorry to hear your troubles Frank
David
Again, I absolutely don't wish to overstate this as a 'problem', certainly in light of everything that's going on in the world. Just keep you updated on the developments.

ISUK:Sorry to hear your problems continue Frank. I've just been reaquainted with the joys of running modern Ferraris myself. I sent my Roma off for it's first service and they carried out a software campaign on it without advising me of what would be changed as a result. The car has come back without the modern display functionality that it was heavily sold with as it appears the Italians are incapable of resolving slow running software so just resort to switch off functionality instead. I kid you not as this is the official communique from the factory -
Anyone who has paid the significant charge for the passenger display option is surely going to be angry. I didn't bother with that option and my system ran fine without any bugs or glitches prior to the downgrade. I've complained to the factory and requested they reflash my car back to the previous software version but after being told my complaint was being passed to the relevant department, I have heard nothing.
After that I suffered a problem with the factory fitted security tracking system on my 812 GTS. It would not pair up with both key fobs and then the main unit hidden behind the dash locked itself and nobody could access it online to reset it. There followed a comedy of errors with my car being picked up by the supplying dealer for supposed instant attention which then turned out to be them not even having looked at the issue some six days later. I had to kick off to get some action on it and from then on the Keystone Cops took over and it descended into a farce. I insisted they rip out the useless unit fitted by the factory and replace it with a much better system by the same tracking company that comes with an online app like the Porsche security system. They ending up agreeing and I finally got my car delivered back yesterday after they had it for 18 days. I took it out for a drive and the frustration at the poor level of service melted away.
A friend who has a 458 spider had a fault on one of the TFT display screens. He has had multiple visits to this same dealer (they are not my regular Ferrari dealership) to try to get it resolved. He's lucky they did it under warranty as they have followed the factory's advice and replaced a cable to start with, then the full dash display and finally had to fit a new NIT unit. On each occasion they claimed to have fixed the fault but after driving it for only 15 minutes once they had dropped it back to him, it failed again. It would appear that replacing the NIT unit has finally solved it. The cost of all of this runs well into 5 figures.
Vigna and his team will surely destroy the brand by 2030 with all EV and nonsense touchscreen
DJM48:Hi Frank
Any news on your car?

It's too absurd for words... We've been negotiating on a price for them to take the car back. Negotiating on the basis that the car was finished an trouble free. Their proposal being too low to be reasonable talks failed and we'd take the car back on the condition it is now fully sorted. When arranging pick up it appeared they were still working on the car (it's with them since March(!), they're changing the cats now. With that in mind they were not negotiating transparently with us, and I'm taking further action. Fed up with it.

Years ago we had a series of problems with a new Volkswagen Golf that we used as a runabout town car. We worked with Volkswagen and when they couldn’t satisfactorily resolve the situation, we agreed on a buyback of that car. It’s amazing that Volkswagen 30 years ago was more professional about resolving the problem and restore customer satisfaction with a low cost car than Ferrari. Just sad. Hope you get some legal resolution soon.

Does the EU have arbitration clauses in their contracts? If so, rather than litigating the issue, either agree to mandatory arbitration or mediation. I have sat as an arbitrator in vehicle disputes between customer and car manufacturer. I have on occasion required the manufacture to take the car back with full refund to the customer.
The purpose of life is to enjoy the moment.

Depends how much you pay your female lawyer I guess.
Unfortunately a male lawyer, but that said, a brilliant guy and a fellow petrolhead. Always a pleasure!
Meeting done, left with a good feeling, let’s see if it materializes. Will comment publicly as soon as there’s an outcome good/bad.

watt:Well Frank,
Ferrari certainly damaging future sales with their behaviour toward to you, and then major brake debacle. As a public company - pressure from your lawyer, especially publicised will get a reaction.
Well as it stands, he refused our last amicable offer -if he doesn't get support from the factory-, deadline until Wednesday.

It seems it'll go to court, instead of an acceptance or a counter offer, we received a reply from their counsel. An extremely ill-informed reply at that, stating that we had no basis to ask for compensation.
I think our proposal had been very reasonable, we took a lowly market offer (275k CHF) and asked for 50k CHF in compensation on top for the +300 days the car has been in repair over the course of two years.
Speechless...
