    Nick it sounds more like a lifestyle code...yes  but I thought Elkann’s camo Ferrari was in far worse taste, and apparently it was OK.  Maybe it helped being an Agnelli grandson...

    It's Europe so the law and threshold of proving harm to the trademark Ferrari is different from whatever the courts in the US might say.

    I'm sure Nick would have fun with Ferrari because the has hammered them four ways from Sunday before.

    The owner should face the UN Fashion Court for the crime of being a visual nuissance against humanity!  That wrap, those shoes ...are they bright enough? Is he trying to attract crows to gather guano? All very de classe!

    Ferrari sued Philipp Plein? Seriously? This will backfire big time, they are sooooo dumb. Smiley

    The irony. ....... they have actively encouraged over the top creations through their Atelier service in recent years to boost profits. Many other brands - Aston Martin, Bentley, Lamborghini, Mclaren,Rolls Royce etc - - have followed suit and allowed some very polarising cars to be built in the pursuit of profit and the hope of increasing brand recognition/desirability through social media views. Ferrari will be pretty busy suing themselves for distastefully tarnishing their brand  if this case were to gain traction in a court smiley

    Never have I felt any reason to post nudes of myself online, but if it had been me, I would definitely feel the urge of posting close-ups of an unwiped sphincter next to the logo of the prancing horse, with lots of ferrari hashtags... what utter bullshit!

    Ferrari management take their brand and themselves too seriously, it seems. A habit from the time of their glory days, when they were playing alone.  Nowadays, people can choose from the revived Lamborghini and the emerging McLaren some top products. I wouldn't be surprised if the new Corvette is a worthy rival too, if the snobbery factor is removed.

    Not to mention F1 where Ferrari have become a joke, in what used to be the cavallino's own turf.

    If he’s using the Ferrari image and brand to sell his shoes without a prior agreement or their approval  that could be a cause of action in the US.

    Philipp Plein's net worth is around 180 Mio USD, his company made 300 Mio revenue last year. This is not a small vendor Ferrari wants to scare, this is a heavy weight, he certainly can afford the best lawyers out there (and I have no doubt that he is not going to give up easily).

    However, unfortunately for Ferrari and its very-valuable trademark rights (assuming this does not go down well), regardless of whether its approach is legally appropriate (and it almost certainly is), the mob that is social media quite often lacks the willingness and/or the ability to make such distinctions. So, let the potential PR mess ensue … 

    Well...this is going to be interesting.

    I think it's more like Ferrari itself didn't initiate it, it was the law firm. The lawyers think they could extract money from Plein, propose to Ferrari and was then given the go ahead.

    Don’t they have an arrangement with Puma? That would be the only explanation I’d come up with, given that Plein promotes his shoes in very close vicinity to the manufacturer’s badge on these pictures.

    That makes the whole story somewhat awkward nonetheless...

    Honestly, I never knew this designer Plein even existed until his misunderstanding with Ferrari.

    From what I read he has been in business for 20 years he has a turnover of $200+ million from a number of international outlets and his net worth is estimated at $180 million. Judging from this pair of shoes, his designs might not be to my own liking but apparently he is enjoying success elsewhere.

    I don't think he has a need for his products to be photographed on top of a Ferrari car in order to gain any marketing benefit. Someone could say that it is Ferrari who are gaining attention from  this affair rather than Plein.

    IMO It was an impromptu photograph and if Ferrari thought it was improper they  should have dealt with it in a discreet and private manner.

    Yes, dealing with it in a discrete and private manner would have been a better approach, except it would not deter others from pulling similar stunts in the future.

    Philipp Plein is a pretty well known designer, even my wife has a few pieces (mainly t-shirts) from him but it is an acquired taste, I agree, I wouldn't really buy stuff from him but he is very successful in Asia and even in Europe, especially in the ages 25-45 demographic (I would say).

    You don't have to like his stuff (like I said, I don't have anything from him) but he has won several fashion awards and while he isn't in the same league with Karl Lagerfeld and others but still, he is successful.

    Also, he is well known as an egomaniac, so I don't think he is going to let this go easily. Ferrari should have talked to him as a customer first before suing him, I think this whole thing isn't good publicity for Ferrari but pretty good advertisement for Plein. Smiley

    Ok, I might be in a minority, but doesn't Ferrari have a point ?

    He's using the Ferrari brand to promote his own products (implying that there's a link between owning his shoes and owning a Ferrari = success)...that can't be right. Yes, he's using a private account and not his company's, but a lot of his customers are following him on his social accounts. Ferrari won't succeed in a lawsuit, I assume, but I have to agree with Ferrari on this. 

    Now, if it were a simple snapshot that he shared among his friends in a bar or restaurant for the purpose of bragging, or what not, then it would be ok I guess, but on social media, where hundreds of thousands can see it as free advertising at the expense of Ferrari, I'm not sure.
