    i'm just a porsche loving university student which makes it hard to believe he let me go. It was in outside the city on country roads so it wasn't down "main street" which would be even more dangerous. I think he might have had an appointment or something cuz right after he let me go he turned around and drove the other way; Other than that i don't know why/how i got away with it.

    All this talk of 12 month bans etc is a load of crap.

    If you have a clean licence you will recieve either 5 points and a big fine or a ban of 1 month or 2 months. You only get banned for 12 months etc under the totting up procedure.

    Where you got caught will also determine your ban/fine etc. If it was leicestershire police you may be lucky as it is loughborugh courts that are reasonable lenient if you act sorry enough. Nottinghamshire courts are a lottery. the rest I have no idea about but basically they all vary a lot.

    As for how you were caught this is the interesting part. You need to get yourself on www.pepipoo.com and the expersts will help you and advise of the best lawyers if that is the route you wish to go down. I think that if they were genuinely too far back that you may have a good case of arguing that they could not possibly be accurate on their timing of you poassing each fixed point. However the experts on there will give you some real help.

    Anyway don't worry about it as there is nothing you can do about it until they issue court papers.

    I talked my way out of a 12 month ban after I gained 6 points while having 6 on my licence. So anything is possible.

    A good few years ago I was VASCAR'd on the M5 at 107mph. I went to court, pleaded guilty, apologised and got a 2 week ban and a smallish fine. A guy appearing just before me argued his case not to be banned for doing 106mph - also in a Porsche. His brief suggested an onerous fine but with no ban. The bench stated that if he could afford an 'onerous fine' he could also afford someone to drive for him!!

    The upshot was - he received an onerous fine plus a 3 month ban!! Seems my humble approach was far better received than his or his brief's. FWIW

    Not that I encourage speeding, but here in South America where I live we have plenty of open roads and no cops with speeding checks. There is one main road to the coast that ocassionally and during the weekend there is ONE cop with a X o K gun but very predictable. True there is hardly any P car around, most cars speed to max 140 kms hour. You are on your own.

    i got caught 108mph on m1 junction 2 and 3 right after the service station in october last year, with my road angel bleebing a bmw chasing up so i brake hard to slow down,

    they just show me that i caught 108mph on speed gun and will facing court and baned for few months but untill now i still hasnt recieve any letter or note to face court!?

    Bazza, keep everything crossed, once it's gone 6months from offence you're a free man. They have to summons you within 6months of the offence, if it's outside that and they still summons you it's fun to go along to court, point out that it's more than 6months and the JP's will wave you away scott free. However, in my experience it's quite common to get the summons just before the 6months are up.

    I got caught doing 83 in a 30 limit, and got off with 6points and a Pounds200 fine - Luckily i was driving my boring Rover 600 (they didn't read out in court that it was the Ti!) rather than my Norfolk Mustard V8 Esprit - otherwise I suspect the outcome may have been different!

    The advise of my UK solicitor. Is to ignore all speeding fines. Apparently quite a few either get lost, fall out of the system or just don't get followed up due to the huge quantities in the system.

    Judging from my experience (my best friend of course!) in a percentage of cases this advise is good and does actually pay off!!

    If it is a simple camera type offence I would agree but if stopped by the Police they just hear the case in yoru abscence and do you big style

    I agree with JJB. I'd say get a good solicitor, a pleading letter from your employer and find a credible story as an excuse and for some sympathy. Ignoring it could land you in a whole lot more trouble. There, but for the grace of.....

    My biggest worry in the UK is getting caught in my car or on my bike. I'm glad you were doing less than 120. Some bike guys have gone to jail just for speeding....

    How far behind you were they? Could YOUR car be positively ID'ed on the video? Did you disappear out of sight at any point? Did the give you a NIP when they stopped you? Were you positively ID'd.

    Be careful with lawyers, for every Nick Freeman there are 10 others who will happily take your money and do sweet FA(this includes some who advertise themselves as motoring specialists in the yellow pages).

    At 118 expect a 6 month ban and a fine.

    You have two choices,

    1 - go to court, eat humble pie, say your sorry, act weak and poor, grovel and hope for a short ban and small fine. Magistrates are like school teachers, they LOVE it when you grovel and act all weak. They HATE it when you challenge the system or act like a smart ass.

    OR

    2 - challenge them and hope the CPS offer you 5 or 6 points and a small fine rather than take up court time. If you make out your're going to challenge them on every point they may do this to save PoundsPoundsPoundsPounds. However, if they don't and you fight them hard and lose, expect a longer ban/bigger fine.

    WHATEVER YOU DO, DON"T BRAG YOU HAVE A LOT OF CASH, BIG HOUSE etc to the magistrate, they'll nail your ass x2 for this. If found guilty they'll ask you how much you earn, your mortgage payments, house value. Make out you are one rung away from bankrupcy.

    And finally, be a bit more discreet, I wonder how many Boxsters have been stopped at 118mph on the M1 recently by a traffic car???

    no court in athens they took my license for 3 months because i was speeding (240 km/h in athens oops sorry)

    They gave me no paper work. Just said I'd hear from the courts in due course. I may have gone out of sight too I'd have to see the video to make sure.

    Completely agree with what sjn2004 has said.

    But just to add that, if you plead guilty, you'll have to fill in a 'means test' form BEFORE the case is heard. So take time to fill in this form and make sure it 'balances' to your advantage - it will be used to help determine the size of your fine.

    Also make sure you attend court in person and not have it heard in your absence. That way you can grovel more effectively and the magistrates will see that you're taking the offense seriously.

    Although you must seek professional advice, if you decide to plead guilty and throw yourself at the court's mercy, it is often quite beneficial to present your mitigating circumstances yourself and not via a solicitor. The Clerk will be more helpful to you as they are there to advise on precedures etc. You would also reduce your own legal costs and those claimed against you by the police.

    Boxsterboy, you didn't get anything when they stopped you? Normally they would give you some paper for a producer etc or to explain why they stopped you. Did you show them your photo licence by the roadside(so they ID'ed you as the driver)? They have to give you a NIP within 14days either verbally or in writing.

    If you went out of sight in the video, how do they know you were the same car that was speeding? Was visibility poor, or at night, making ID more difficult/less certain.

    It may take months before you hear from then again, had a friend, he'd almost forgotton about it then the summons turned up maybe 5 months after the event.

    What is it with people talking [censored] on here. You won't get banned for six months unless it was through totting up. A 30 or 60 day ban is all you get for that speed and thats only if you don't convince the mags that they should really just give you 6 points and a fine in your Oscar speech.

    JJ you're not a journalist are you by any chance? You missed off a few from that list including,

    101mph 70 M Mobile Gatso Instant 1yr ban and retest.

    There were also a few others in that list from 3mths to 1 yr although the 1yr bans included a retest suggesting the individual had only passed their test recently.

    In the offence table on that site its states

    36+ over the limit = 1mth to 1 yr ban.

    It is only a 12month ban if you already have 6 points on your licence prior to this offence. In all other circumstances it will be no ban, a 30 day ban or a 60 day ban according to your luck on the day.

    I can recommend Nick Freeman. He's not cheap but his record speaks for itself. By the way his first piece of advice is do nothing until you actually receieve the notice of intended prosecution. Quite often, as others have said here, they get lost in the post.

    Mr Freeman got me a case dismissed from being stopped on the M6 doing 116mph - my defence was duress.

    Cost me a couple of thousand pounds but well worth the ability to continue driving.

    So how do they determine 1 month to 12 month?

    1 month or less is the normal punishment for 36mph + on a clean licence and a bit of grovelling.

    2 months is just a magistrate in a bad mood.

    12 months is for those WHO UNDER TOTTING UP REACH 12 POINTS !!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

    Boxsterboy has been caught speeding at 36mph plus and assuming that he can be found guilty according to the evidence, will face a punishment between 0 ban and 12 months.

    Boxsterboy has already said in this thread that he has a 'clean licence'.

    THEREFORE HE CAN ONLY BE BANNED AT A MAXIMUM, 2 MONTHS !!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!
