    Ford suing Ferrari over F150 name

    Ford is suing luxury automaker Ferrari for trademark infringement after Ferrari named its 2011 Formula 1 racing car the ‘F150’ – the same name as a Ford pick-up truck

    What's more, Ferrari's F150 logo bears striking resemblance to the one on Ford's F-150 pickup truck, the top-selling vehicle in the United States, Ford said in a complaint filed in federal court.

    "Ferrari has misappropriated the F-150 trademark in naming its new racing vehicle the 'F150' in order to capitalise on and profit from the substantial goodwill that Ford has developed in the F-150 trademark," Ford said in a complaint filed in US District Court in Detroit.

    You can see the comparison of the two logos below, with the Ferrari logo being on top.

     The way the law works in the States, you're expected to defend every trademark infringement. If it can be shown that you let one slide, it can be taken as a sign that you'd don't enforce your own copyright.

    And certainly, in a case where it is SO EASY TO CONFUSE a pick up truck with an F1 racer, you can see how important this is.

    But Ferrari is owned by  Fiat, which owns Chrysler , which is a competitor to Ford. There you go !!!

    Ferrari would of course act the same way if the situation was the other way around. 
    Otherwise, the next thing you know there'd be something like a Pontiac GTO.

     Listen, in these tough times it's important to have work for the lawyers to do. Otherwise they might get up to mischief.

    By the way, I'm working on trademark papers for the letter "E", both upper and lower case usage. Apparently it's in public domain right now, but if I can get the rights, look out baby!!!

    See what you can do about grabbing the rights to trademarks starting with a lower case "i" while you are about it.  Smiley

    You have to know a bit of the tenuous history between Ford and Ferrari.

    About 50 years ago, Mr. Ford made an offer to buy Ferrari. Mr. Ferrari accepted in principle and then at the last minute, pulled out.

    Ford was both insulted and vendictive. He commissioned the GT40 specifically as a "fuck you" to Ferrari to ensure that they would not win any sportscar races that year - and subsequently, Ferrari lost to the GT at nearly every outing including LeMans.

    Ever since then the Blue F never passes on an opportunity to stick it to Red F.

The ones that do hear about it are enthusiastic enough to see the difference between them. Also believe that the driving reason behind this action is more politically and judicially motivated.

     4) If Ford is suing Ferrari, that means Ford must prove that Ferrari is benefiting from the goodwill. Please tell me how many Ferrari purchasers buy a 458 because of the excellent reputation of the a Ford pickup truck Smiley

    Now you know why there will be no Mustang with a 5.9 liter engine named the 599 GTB

    In the early 1960's Peugeot sued Porsche for Porsche wanting to market the original 911 as the 901.

    Peugeot won, claiming that 3 digit model numbers with a zero in between for production cars was part of their trademark portfolio.

    But that could not stop Porsche from using 904, 9067, 908 for their race cars or for 911 parts.

    A Ferrari F150 model designation could harm Ford. No potential Ford buyer wants to think that his truck may requiore Ferrari priced parts!

    "It might seem like a Kafkaesque scenario, but the affair relating to the name of the car with which Fernando Alonso and Felipe Massa will tackle this year’s Formula 1 World Championship saw its final and decisive episode played out these past few days with the concomitant withdrawal by Ford of the summons. Therefore common sense has prevailed. 

    In order to avoid the slightest risk of anyone confusing a Formula 1 car with a pick-up truck, for their part, the men from Maranello have decided that the car will lose the F that precedes the number 150 and which stands for Ferrari, as it has done on numerous occasions when it’s come to giving a car a code name, be it for the race track or the road. It appears that this could have caused so much confusion in the minds of the consumer across the Pond that, at the same time as losing the F, the name will be completely Italianised, replacing the English “th” with the equivalent Italian symbol. 

    Therefore the name will now read as the Ferrari 150° Italia, which should make it clear even to the thickest of people that the name of the car is a tribute to the anniversary of the unification of our country. Let’s hope the matter is now definitely closed and that we can concentrate on more serious matters, namely ensuring that our car that already seems to be pretty good out of the box, becomes a real winner."
