Ignoring the PSE, in this case I think it is more technical than legislation.
The sound is always an issue regarding sound emissions laws, I had a pretty interesting talk about it with Porsche engineers. They can produce the sexiest sport exhaust sound but they cannot certify it. Yes, limitations may be of technical nature but these limitations can be overcome but when they do, the sound is too loud at certain rpm or speed figures, so they cannot legally certify it. Best example: The new 991 Turbo/S. Great improvement over the 997 Turbo/S but still not perfect. The technical limitation would be the VTG chargers but there is a solution. Unfortunately this solution cannot be certified because the sound gets too loud.
How do third party aftermarket suppliers to it? Well...they have it much easier than Porsche to legally certify their products. The same is valid for small production figures manufacturers like Ferrari for example.
