    RMS Leaks- Is Nick or any other attorney want to handle class action suit?

    A friend has a 05 Boxster with a RMS leak.  A design flaw with the engine.  The dealer stated back in June there was no RMS leak (he said the oil change caused it!).  Car is at the dealer and now he says the leak is more than it should be and is an RMS leak.  Porsche will not help. 

    This should have been corrected by Porsche in their design but has not.  Now we are ready to file a lawsuit against them.  Any attorney care to participate for class action status?

    Good luck. Many cars (not only Porsches) have RMS leaks. Some rare RMS leaks are catastrophic, but the great majority are not.

    Why a class action suit? Have your friend contact a lawyer and as an individual sue Porsche to repair his car.  Class actions suits are very expensive and difficult to certify as class actions.

    Nick, do you have any recommendations for a good lawyer in the Orange County/ Los Angeles area?

    What irks me about this whole thing is that I discovered the RMS leak one week out of warranty and the dealer said no it was not a RMS leak at the time.  Now several months later, the car was back in the shop (replaced the oil separator) and they did document it as a RMS leak from the first visit.

    The owner never new what a RMS leak was and by the looks of it the leak was there for sometime.  If the owner knew that a drop of oil spilling from the car was something serious, I am sure she would have been on the lookout and taken it in for warranty repair.

    In a lawsuit, it would be interesting in discovery, to find out exactly how severe the problem is.

    Doesn´t Porsche cover RMS leaks even after the warranty expired? If the car has been regularly serviced and does not feature modified components, there should be the possibility to adress this, even at PCNA directly.

    A claim is with PCNA right now.  We will see what they say.  The dealer already said no they will not cover it.

    Getting a lawyer to pursue damages for the RMS fix will be expensive. The attorney will have to charge by the hour with you paying all expenses.  A modicum of discovery would cost more than the fix itself.

    My advice given the facts as you state them, aggressive campaign Porsche to repair the RMS. DO NOT ACCEPT NO FOR AN ANSWER! Continue to escalate the issue to Porsche upper management if you fail get a satisfactory answer.

    As a last resort, if Porsche continues to decline the claim offer to put the matter into through the American Arbitration Association. Most car manufacturers have agreed to settle owners disputes using the AAA facility. You don't need an attorney to make your case and the cost is minimal. It is decided by an arbitrator ( I was one for many years) who is selected by the parties.

    NEED HELP!

    At first the dealer stated that the cost of the RMS repair was going to be $1200.

    So we called PCNA and they agreed to give a voucher for $600 based on the $1200 repair cost.  I asked the Porsche representative several times that if the cost was going to be $1200 and she stated that yes, that is what the dealer stated.

    So the car goes into repair and the dealer is now quoting $1900, $3450 and a third number.  The service manger also states that he never talked to PCNA, even though when I called on Monday, the PCNA representative stated that she talked to him an hour earlier.

    Nick, what should we do?
