Do I need to litigate with Porsche...

It's been two weeks since requesting my CGT deposit back. I've not heard anything since a week ago last Wednesday despite certified mail and e-mail. While the contract is stated to be non-refundable, my understanding is non-refundable auto contracts are not valid in CA. Is this the case and what is my next step? TIA

Re: Do I need to litigate with Porsche...

Seems to me that a week isn't a very long time. What's the hurry? The statute of limitations is a lot longer than a week. Calm down. There will be lots of time for litigation if need be. For now, keep things pleasant. Remember, you can never go backwards.

Actually it's been two weeks and SOME communication would be more than acceptable.

Different issue. But you're dealing with a large organisation and talking about a big sale. They're probably trying to figure out what to do and how to approach you. takes time. So just calm down. I know you're getting antsy and want a resolution but you need to relax a little and let things take their course. The time isn't costing you anything. Interest rates are relatively low now.

Did I tell you how long it took me to satisfactorily resolve my PCCB problem? Two years. But I never had to go to court. That was important in a place like Belgium.

So just calm down. You know you will get a response from them sooner or later.

Re: Do I need to litigate with Porsche...

Fair enough, I just don't want a call in a month telling my car is ready.

Re: Do I need to litigate with Porsche...

You've sent notification via certified post, return reciept requested? So there can be no doubt about them having received notice.

Are there any special requirements of California law? If there was a reason to get a local lawyer involved, finding out that would be the reason. But I certainly wouldn't be asking the lawyer to intevene directly just yet.

But if you have a friend who is a lawyer, a call on your behalf may work wonders. Where is Nick when you need him?

Bearing in mind Nick's skills at analyzing situations and building up persuasive arguments to support his case, Ben could find himself being the first person in history being sent to the electric chair as the outcome of losing a civil suit.

Porschephiles especially those in Germany can never see my logic because everything to them is either black or white. It requires analytical skill to reason within those two points and sadly therein is the problem.

Example; if I was was positive about Porsche I have no doubt I would have the enthusiast support of the board regardless of the merit of what I had to say. You see its either black or white. As our madman in the White House states" your either with us or against us".

Finally, when people ask what kind of lawyer are you, my response is always the same; A LOUSY ONE! Somehow I manage to get by comfortably.

Nick, due to your occupation you will know quite well what your words are doing on this board. You know yourself that you purposely balanced on a knife's edge - and I don't think we need to discuss this any further...!

Ben, Curious how your story ends but I sad to hear that you cancelled your order! Well, it's not about peanuts!
